Pinfishing.com terms and conditions

Small Partnership Kimba.lt (hereinafter – the Supplier) requires that all visitors (hereinafter – Users) browsing on this website (hereinafter – the Website) shall comply with the following terms and conditions. By entering the Website, a User shall acknowledge and agree to follow and be bound by these rules (hereinafter – the Rules).

1. General provisions:
1.1. Small Partnership Kimba.lt, company number 302935536, registered in the Register of Legal Entities of the Republic of Lithuania (hereinafter – the Supplier) manages and administers pinfishing.com.
1.2. In terms of the Rules, the use of pinfishing.com shall include all and any kind of actions performed by Users connected to the Website through an internet connection. In terms of the Rules, the service shall include all and any kind of actions performed by Users on the Website, including, but not limited to, the uploading of angler's catches, the creation of fishing events, communication on forums, private messaging, the reading of information, the writing of reviews and comments, the presentation or reception of any type of information and/or data, etc.
1.3. A User shall comply with the terms and conditions by using pinfishing.com in any way or form. If Users do not agree to be bound to any of the aforementioned rules, they shall not have a right to access and/or browse pinfishing.com.
1.4. User access to the Website and the use of it shall be regulated by the laws of the Republic of Lithuania, European Union law and international law.
1.5. The Supplier shall have a right to unilaterally change the services provided on pinfishing.com, as well as any provisions of the Rules. If a User continues accessing and/or browsing on pinfishing.com after changes, amendments or modifications have been done, it shall be considered as a User's consent to the amendments of the Rules. If a User does not agree to the amended Rules, he/she shall lose their right to access and/or browse the Website.

2. Guarantees and liabilities:
2.1. The Supplier shall endeavour to ensure the smooth operation of the Website; however, it does not give Users any guarantees for the continuous functioning and permanent availability of the Website. Pinfishing.com reserves the right to limit or terminate the activities of the Website or part of it at any time without prior notice.
2.2. The Supplier shall not be responsible for inaccuracies or other errors that occur in the content of the Website. The Supplier may make changes or corrections at any time.
2.3. The Supplier shall not be responsible for uploaded content and shall reserve the right to edit it if Users breach the Rules or provisions of any laws. Also, pinfishing.com shall have the right to remove content uploaded by Users of the Website unilaterally, at any time and without prior notice.
2.4. Users of the Website agree and acknowledge that all content of the Website, which they read or download, is selected exclusively at the User's discretion and risk; therefore, a User shall be responsible for any incurred damage.
2.5. To the extent permitted by mandatory laws, the Supplier shall not be liable for any direct and/or indirect loss that may be suffered by Users or third parties due to the content of the Website, the Website malfunctioning or the correctness and legality of information uploaded to the Website by third parties.
2.6. The Supplier shall not be liable for the correctness of the information related to products, services or political advertising provided by legal or natural persons, the quality of such products and services, or any consequences arising from the use or failure to use their advertisements.
2.7. In cases where the Website contains links to other websites, the Supplier shall not be responsible for the content of information uploaded by them because it does not maintain, represent or control such websites.
2.8. The Supplier reserves the right to change the Website and/or services or individual parts of it, as well as its content, functions and any information, including that uploaded by a User and and third parties at any time, without prior notice. A User understands and agrees that the Supplier shall never be held responsible for any negative consequences caused by these and other similar actions; therefore, a User refuses to express any claims to the Supplier regarding such actions.
2.9. The Supplier shall have the right to limit or terminate the User's access to the Website and/or use of Website services at any time, without prior notice, for an indefinite period of time and without giving any reason.
2.10. During the performance of preventive work, the Supplier shall have the right to limit or terminate the provision of services for an indefinite period. In this case, Users shall be informed about the beginning of preventive work in writing no later than one (1) hour before the beginning of the work.
2.11. The Supplier shall have the right to terminate the Website completely at any time and without prior notice.

3. The following shall be prohibited:
3.1. Providing information on the Website which violates or may violate any applicable laws of the Republic of Lithuania, which conflicts with generally accepted ethical or moral standards and does not comply with the Rules.
3.2. Promoting any kind of products and/or services;
3.3. Impairing the smooth performance of the Website and hindering others' use of it.

4. Intellectual property rights
4.1. The Supplier is the owner of all rights to pinfishing.com content and shall have the exclusive right to enjoy them. All trademarks of products and services, designs, titles, logos, etc. presented on pinfishing.com are the property of the Supplier or the Supplier has the right to use them.
4.2. Any kind of pinfishing.com content or design processing, copying and/or other use performed by third parties without written consent of the Supplier and/or non-compliance with the Rules shall be deemed in violation of copyright and other rights and shall be punished in accordance with the laws of the Republic of Lithuania.
4.3. The User agrees that the Supplier shall provide any right to use photos uploaded by him/her to promote its company, without disclosing the personal information of the User. The User agrees that the content published by him/her, including any kind of intellectual property shall be a part of the Website database and allows the Supplier or its authorised persons to store and use it in accordance with the laws for an indefinite period, unless otherwise specified in the Rules. Neither the Supplier, nor a third party, using the content published by the User, shall be obligated to pay a royalty or other fee to the User for the use of such content.

5. Miscellaneous
5.1. By submitting any information to the Website, a User shall accept full responsibility for its compliance with the terms and conditions of the Rules and laws of the Republic of Lithuania. By publishing information, a User shall confirm and guarantee that the information provided is true, accurate and complete.
5.2. The Supplier shall have the right to unilaterally remove all parts of the User's login information, as well as any kind of information provided by the User in order to use the Website, to modify it, to restrict the opportunities or to prohibit the User from using all or part of the Services and/or to access all or any part of the Website without prior notice.
5.3. At the first sign of infringement of any laws of the Republic of Lithuania or the legitimate requirements of law enforcement, the Supplier shall forward all available information about the User to the relevant authorities of law enforcement.

6. Applicable law
6.1. The activities of the Website are performed in accordance with the laws of the Republic of Lithuania. Any disputes arising out of the activities of the Website or related to it, shall be settled by negotiation; however, in the event of a failure to agree, a dispute shall be forwarded to a competent court of the Republic of Lithuania.
